Re-zoning Meeting Delayed Again For 159th & Metcalf, SE Corner
Commission To Consider Application December 10.

The re-zoning application (REZ-0023) for the SE Corner of 159th and Metcalf was to be considered by the Overland Park, KS, Planning Commission on November 26, 2007. However, the developer has submitted a revised plan which converts more land to commercial rezoning and hence requires residents to be notified again. The Planning Commission will now include the application on the agenda for the December 10 meeting.

The revised site plan continues to have a significant error in it, as did the previous.

The newest application site plan, like the previous, shows RP-3 residential zoning. The actual residential re-zoning being called for is RP-5, not RP-3 as the site plan states. RP-5 is required to accomodate the fifteen 3 story apartment buildings being requested, which would not be allowed under RP-3. The Planning Staff pointed this error out to the developer, but it was not corrected.

The previous site plan submitted by the developer erroneously stated there were 481,629 sq ft of retail/office. The actual number was approximately 390,000 sq ft. Like the recent submission, it would be anchored by a 170,000+ sq ft Lowe's.

The new plan converts more of the residential land to commercial, raising the total commercial square footage from 390,000 sq ft to 417,997 square feet.

The Master Plan for the 80 acre tract calls for residential, low density zoning with no commercial or office on the entire tract. The tract abuts Blue Valley Riding neighborhood (1+ acre lots) and is across 159th street from Willowbend (R-1 zoning).
