I understand from one of the leaders of STOP, which is fighting Target, that the first hearing before the Planning Commission has been postponed, probably until May. According to Frankie Peschl, City Councilmember Neil Sader informed him of the decision by Polsinelli to request this postponement. Leslie Karr, Senior Planner for Overland Park who is handling the Target application, had not yet received the formal, written notification from Polsinelli.
This will give the Polsinelli law firm the chance to correct the errors it made in the last protest petition notifications. The protest petition notification letter had been drawn from the center lines of the street, rather than from the property boundary. This violates ordinance and had the effect of adding more land and people to the protest petition area, and excluding part of a parcel of private roadway which a Home Owner's Association may vote on the multifamily petition.
