New BVHS Stadium Sound System
Planners Recommend System and 60dBA Sound Limit

The following letter is the recommendation of the Johnson County, KS, Planning Department to the Oxford Township Zoning Board on the proposed Blue Valley High School public announcement system. The recommendation is for approval of the sound system subject to the 60dBA limit set forth in current Johnson County regulations.

Neighbors who have worked with the school over the last two years on this effort are very pleased with the work done by the school and its consultants and also support these recommendations. Two key changes have occured since the original proposal was submitted:

  • The new design is cheaper and quieter in the neighborhoods than the original;
  • The staff eliminates the provision for the loud 67dBA variance and adopts the standard of 60dBA which already is in place in the Johnson County regulations.

Re: Blue Valley High School, 6001 W. 159th St, Changes to athletic stadium public announcement system.

This application is back before the Zoning Board due to changes/developments that occurred after the last meeting in January 2002.

Background

On April 20, 2000, the Oxford Township Zoning Board considered a request from the Blue Valley School District to make certain improvements (bleachers, dressing rooms, concessions, etc.) to the existing athletic stadium at Blue Valley High School. The zoning board recommended to the Board of County Commissioners (BOCC) that the stadium improvements be allowed and included a stipulation about any future changes to the stadium’s existing public announcement system. The BOCC approved the request of the school district on May 18, 2000 including the following stipulation:

2. If changes are proposed to the existing public announcement system, the School District shall hire an acoustical engineer that shall design a sound system that does not increase the noise level of sound in the surrounding residential neighborhood. The sound system shall be presented to the zoning board and approved by the BOCC. On January 17, 2002, the Zoning Board considered a request from the School District for a new public announcement system at the existing stadium. At the conclusion of their discussion, the Zoning Board recommended approval of the proposed system with the follow stipulations and for the following reasons: Stipulations:
1. The project shall be completed as described in the June 26, 2001, Sound System Description for the football stadium at Blue Valley High School, and the November 21, 2001, Acoustical Design Group letter.
2. The District shall ensure that the sound that results from the operation of this new public announcement system shall not exceed 67 dBA (slow response of a sound measuring instrument) when measured at the reference points (16315 Dearborn and intersection of 159th Terrace and Russell) in the adjacent neighborhood.

Reasons
1. The school district and county have hired acoustical professionals to design a system that will improve the on-site and off-site effects of the current public announcement system.
2. Provided the school district oversees the operation of the new system, the proposed changes will not increase the level of sound in the adjacent residential neighborhood.
3. Provided the school district oversees the operation of the new system, the proposed changes will improve the quality of sound thereby reducing the objectionable effects of sound in the adjacent residential neighborhood.

More Recent Developments

Subsequent to the Zoning Board meeting it was discovered that the County has a zoning regulation relating to controlling noise that the proposed 67 dBA would violate. The regulation indicates that in no case shall the noise level exceed 60 dBA in the residential district measured at any point along the property line. Therefore, after the Zoning Board meeting, the acoustical consultants were asked to come up with a system that could meet the 60 dBA requirement. The County’s consultant prepared a model of a system that can comply. The School District’s consultant has designed a system in accordance with the model. The conclusions are that subject to adjustments, and once installed, the system now proposed by the School District can comply with County regulations.

Conclusion

Planning staff is of the opinion that the School District’s proposal is in keeping with the original provisions of Stipulation #2, BOCC Resolution No. 039-00 and the County regulations dealing with noise.

Recommendation

Planning staff recommends approval of the Blue Valley High School athletic stadium public announcement sound system project subject to the following stipulations:

1. The project shall be completed as described in the October 17, 2002, Sound System Description (Revised) as proposed for the Football Stadium at Blue Valley High School, Oxford Township, Kansas, attached hereto as Exhibit A.

2. Once the system is installed and prior to commencement of its use, the School District shall complete on-site commissioning (testing, adjusting and equalization) of the sound system equipment such that the decibel level emitted during the use of the system does not exceed the limit set forth in Article 11, Section 7 of the Johnson County Zoning and Subdivision Regulations.

3. Once the system is installed, and continuing throughout the duration of the permit, the School District shall provide the oversight and supervision of the use of the sound system such that the operation does not cause the decibel level emitted during the use of the system to exceed the limit set forth in Article 11, Section 7 of the Johnson County Zoning and Subdivision Regulations.

4. The term of the permit shall be for a period not to exceed 10 years, commencing from the date of BOCC approval of this resolution.

Reasons for Recommendation 1. The school district and county have hired acoustical professionals to design a system that will greatly improve the on-site and off-site effects of the current public announcement system.
2. Provided the school district oversees the operation of the new system, the proposed changes will not increase and will reduce the level of sound in the adjacent residential neighborhoods.
3. Provided the school district oversees the operation of the new system, the proposed changes will improve the quality of sound thereby reducing the potential objectionable effects of sound in the adjacent residential neighborhood.
